The PROPS Partners brand (hereinafter referred to as PROPS Partners, PROPS, "we", "us", "our", etc.) refers to Fair Game Software KFT., a company registered in Hungary, registration number: 01 09 349834, registered office located at 1211 Budapest, Kossuth Lajos utca 62, manages the partner network on the domain of PROPS Partners.com.
Webmaster - the person who places advertising materials on their declared sites (hereinafter referred to as Webmaster). The Webmaster undertakes to comply unconditionally with these Terms and Conditions.
Members of the affiliate network are: Webmaster and PROPS Partners.
1.1. To participate in the affiliate network, the Webmaster must register on the domain registration page https://props.partners/.
1.2. Persons who have reached the age of full 18 years are eligible to register.
1.3. After completing and sending all data in the registration form, the Webmaster acknowledges these Terms and Conditions and agrees to the privacy policy located at the link:

Thus, the Webmaster makes an acceptance to conclude an agreement (offer) on his participation in the PROPS Partners network.
1.4. Upon fulfillment of these Terms and Conditions, the Webmaster receives a confirmation letter to the e-mail address provided by him/her upon registration. Further, the member is required to perform the remaining steps of registration to be able to work in the partner network.
1.5. PROPS Partners reserves the right to refuse to allow the Webmaster to participate in the Affiliate Network without giving any reason.
1.6. After the registration is completed and the account is activated, the Webmaster may use the Partner Network services.
2.1. PROPS Partners provides and manages the Affiliate Network at https://props.partners/. Members of the Affiliate Network are Webmasters and PROPS Partners. Webmasters are individuals or legal entities that provide advertising space on their advertising platforms.
2.2. Webmasters place PROPS Partners' advertising materials on their designated sites. When a user enters the Advertiser's website through an advertising tool on the Webmaster's site and makes a transaction there that ends with a payment, the Advertisement of the Webmaster is deemed successful and the Webmaster receives a predetermined fee. A transaction in this sense is considered to be an action that entitles the Webmaster to receive the remuneration, namely a deposit. The nature of the transaction paid for as a reward by PROPS Partners is specifically defined in the description for each program. A combination of several transaction types is also possible.
2.3. Upon entering into this agreement, Members are notified and agree that PROPS Partners will monitor and record all transactions and provide the Webmaster with information about the transactions and the calculation of rewards.
2.4. PROPS Partners is continuously developing and improving its affiliate network services. Therefore, PROPS Partners reserves the right to discontinue a service, in whole or in part, if it is required to perform preventive maintenance, improve service functionality, or modify service.
2.5. PROPS Partners may suspend payments to the Webmaster if there is a reasonable suspicion of a violation of these Terms and Conditions by the Webmaster, for the purpose of verifying such Webmaster data and/or to verify the quality of the Webmaster traffic.
3.1. All advertising platforms that comply with applicable laws, the Terms and Conditions of this public contract, the privacy policy and the moderators of PROPS Partners are accepted to participate in the activities of the Partner Network.
3.2. Advertising platforms that are under development or purchasing traffic from Active Advertising Systems (CAP, WmMail, Seosprint, etc.), Books and similar systems are not allowed.
3.3. The Webmaster submits an application for participation in the partnership program, thus acknowledging possible additional conditions of participation in the partnership, which are as follows
The advertiser can add to the description of his program and which will be shown to the Webmaster. These additional terms and conditions shall be in addition to these Terms and Conditions and the PROPS Partners Terms and Conditions. The Webmaster agrees that the rules of the affiliate programs are subject to change and undertakes to monitor changes in the terms and conditions of the programs on its own. By continuing to participate in the Affiliate Program, the Webmaster automatically agrees to the new terms and conditions.
3.4. The decision to allow the Webmaster to participate in the program is entirely with PROPS Partners. The Webmaster has no legal basis for such admission if it is decided otherwise. PROPS Partners will determine a test period of at least one month or 20 deposits to evaluate the Webmaster and make a decision regarding long-term collaboration. The terms and conditions for this period are agreed with each Webmaster individually.
3.5. Under the CPA model, the limit for new partners is no more than 15 deposits per day.
3.6. PROPS Partners reserve the right to request data on the source of traffic and access to advertising site statistics, while limiting the Webmaster's participation in the PROPS Partners network. In this case the Webmaster must provide the required data within 14 days.
3.7. PROPS Partners may request the Webmaster to provide the documents and data required to verify the validity of the Webmaster's data. By accepting these Terms and Conditions, the Webmaster agrees to provide data to PROPS Partners knowingly and with explicit consent. The Webmaster's refusal to provide data is a refusal to participate in the affiliate network.
3.8. PROPS Partners provides marketing materials (including tracking links) to the Partner to promote the Brand. The duration of the cookie is 14 days and the last Partner receives a referral.
4.1. The Webmaster must strictly comply with these rules and ensure that the data it submits to PROPS Partners in any way, including through the registration form, is complete and correct. If any of these data changes, the Webmaster must, within 5 days from the date of the change, either change it in his Personal Account or submit a written request to PROPS Partners' representatives to change such data.
4.2. The Webmaster will strictly preserve its data (login and password) to access the PROPS Partners network and will not allow it to be accessed by third parties. The Webmaster is solely responsible for the safety of the login and password.
4.3. The Webmaster warrants that it has the necessary rights to carry out marketing activities at the advertising sites it has declared. He shall bear any legal and property responsibility for what happens at his advertising sites.
4.4. When using advertising resources on his site, the Webmaster shall not violate the rights of third rights holders to the brand, trademark, brand, personal rights and other rights without the permission of the rights holders in accordance with applicable law. The Webmaster undertakes not to use on its advertising site content that violates applicable laws or leads to pages that violate applicable laws. When sending promotional materials containing PROPS Partners' advertising tools by email, the Webmaster is prohibited from using unsolicited spam mailings. To send advertising by email, the Webmaster must have the consent of each recipient and provide proof of this to PROPS Partners when requested.
4.5. The Webmaster shall not take any action that affects the PROPS Partners network. Such actions include attempts to technically affect the performance of the Affiliate Network servers, attempts to hack into security mechanisms, viruses, trojans or other malicious programs for any of their purposes. Use brute force attack, DoS (DdoS) attack, spam, use any tools and processes that can damage the work of the partner network.
4.6. Webmaster has the right to have only one account. An account is created one for one natural person or one for one legal entity. If an individual performs official duties for or on behalf of a legal entity that has an account in the PROPS Partners network, it is prohibited by these rules to create a personal account for the individual to perform his or her official duties for that legal entity.
4.7. The Webmaster undertakes to study and implement the Terms and Conditions in detail for the duration of advertising materials. The Webmaster agrees that failure to perform this duty may result in the suspension of the Webmaster's access to the relevant program, and any losses incurred by PROPS Partners in case of violation of the Terms and Conditions will be written off from the Webmaster's balance sheet. If there are no funds on the Webmaster's balance, the Webmaster will reimburse such losses upon request of PROPS Partners within 10 days.
4.8. Upon request by PROPS Partners, the Webmaster will verify the Source of Traffic and provide all requested files, documents, etc., otherwise the access of the Webmaster to the respective program may be blocked and appropriate sanctions may be applied.
4.9. The Webmaster is prohibited from using any advertising materials and trademarks other than those contained in the https://props.partners Partner program in the creation of any advertising materials, unless otherwise specified. In the event that the Webmaster produces promotional materials for the Webmaster, or if the Webmaster misrepresents any promotional materials provided by PROPS Partners for the Webmaster, the Webmaster shall be solely responsible for the placement of such promotional materials as advertiser and advertiser in accordance with applicable law and shall resolve all claims, disputes, including legal proceedings, and all other disputes, including those with government agencies and third parties.
4.10. The Webmaster will provide PROPS Partners with any requested documents necessary to verify the details of the Webmaster.
5.1. Conducting transactions by methods or means contrary to the laws of Curacao and these Terms and Conditions.
5.2. Imitate transactions by entering knowingly incorrect, non-existent or alien data without the knowledge of their owner by any means.
5.3. Use advertising methods that make it possible to register a paid action, but force the user to perform these actions by deception, blackmail or any other actions that violate the user's freedom of choice.
5.4. Use PROPS Partners or third party data protected by registered trademark, copyright or other legally registered rights of the holder for purposes other than the purposes of these Terms and Conditions. In the event that PROPS Partners' trademarks and advertising materials are used for purposes other than those set forth in these Terms and Conditions, the Webmaster shall be solely responsible for such use in accordance with applicable law and shall resolve all claims, disputes, including legal proceedings, and all other disputes, including those with government agencies and third parties.
5.5. Use advertising materials, including the brand of one Advertiser, to promote the website of another Advertiser.
5.6. Use any technologies and types of cookies (cookie dropping). It is forbidden to use scripts that allow setting cookies on sites that User has not visited or viewed. It is forbidden to rearrange, spoof, rotate User's cookies to other sites which do not belong to the sites which were viewed by the User, including spoofing cookies by using popups, iframe, as well as spoofing when inserting a third party page address as an image on an existing site.
5.7. Register and/or use domains similar to those of PROPS Partners' websites for promotion.
5.8. Use the registered site with a specific declared traffic type to attract another type of traffic through it.
5.9. If the above violations are detected, the Webmaster's account is immediately blocked and all earned rewards obtained through these violations are transferred to PROPS Partners. The Webmaster is notified by the administration about the decision. Once an account is blocked, it is prohibited to create a second one.
5.9.1. For the above violations, the Webmaster shall pay a fine of €500. If administrative or other legal liability is instituted against PROPS Partners due to violations of these Terms and Conditions by a third party, all costs of the proceedings (legal fees) and other expenses resulting therefrom shall be withheld entirely from the guilty Webmaster.
6.1. The Webmaster receives remuneration from PROPS Partners, which depends directly on the success of his advertising campaigns.
6.2. Commission structure and payments
6.2.1. Based on the Revenue share model, commission is paid as a percentage of the Partner's income, which is calculated according to the following formula:
Net Gaming Revenue = (bets - wins - bonuses) - transaction fee & shargebacks - admin fee (25%).
6.2.2. Commission is calculated on a monthly basis as follows:
1-5 FTD 35,00% from NGR;
6-10 FTD 40,00% of NGR;
11-40 FTD 45,00% of NGR;
41+ FTD 60,00% of NGR.
6.2.3. According to the SRA model, a partner receives a fixed payment for making the First Deposit by a player (the amount of the minimum deposit for receiving the payment is agreed upon separately).
6.3. In addition to the fees due, the Webmaster shall not be entitled to reimbursement of expenses incurred for bank transfers or for the use of third party services, programs or services not provided by PROPS Partners, even if these expenses were related to its promotional activities under the PROPS Partners program.
6.4. The fee for the reporting period is calculated within 7 business days after the end of the reporting period and is paid within 3 business days after the total amount is approved by the parties.
6.5. Negative transfers do not apply to commissions.
6.6. PROPS Partners maintain an internal settlement account for each Webmaster through which all credit and commission transactions are processed.
6.7. Partner agrees to refund the fees generated by fraudulent or tampered with transactions and reimburse PROPS Partners Affiliate Program for all costs and losses related to such transactions.
6.8. No fees will be payable if the traffic generated is illegal or violates any provision of these Terms and Conditions.
6.9. No interest will be charged on the amount of remuneration paid to the Webmaster account with the PROPS Partners Affiliate Network, regardless of the time of payment.
7.1. This public contract is concluded for an indefinite period.
7.2. The parties may terminate the contract at any time they wish.
7.3. PROPS Partners may remove the account and data of the Webmaster from the system if:
The Webmaster has not logged into the account within the last 90 days.
The Webmaster has not interacted with the PROPS Partners system outside the web interface (e.g., through an API) for the past 90 days.
At the end of the above period, PROPS Partners will notify the Webmaster that if the account is inactive and not used, PROPS Partners will delete the Webmaster account 30 days from the date of notification and the remaining funds in the account will be written off in favor of PROPS Partners. If no feedback is received from the Webmaster after 30 days of notification, PROPS Partners will delete the account and the Webmaster data and write off the remaining funds in its favor. The Webmaster is notified and agrees that the Webmaster may not restore the account or refund the funds written off after the above deadlines have passed and the account has been deleted.
7.4. If the termination is caused by a breach of these Terms and Conditions, the Webmaster shall pay the fine stipulated in these Terms and Conditions in accordance with point 5.9.1.
8.1. PROPS Partners will only store and process data obtained through the registration and data entry forms in the Webmaster's Personal Web Office, as well as data obtained during the request and participation in the PROPS Partners network.
8.2. The Webmaster agrees to comply with all laws, rules, policies and privacy provisions applicable to the regions in which the services are provided.
8.3. The Webmaster undertakes to comply with all applicable laws, including the GDPR and EU privacy laws, and to do the following:
inform end users about the use of tracking devices and cookies for promotional purposes;
obtain end-user consent for the placing of cookies and tracking devices on end-user devices and provide information about the possibility of rejecting or deleting cookies, if necessary;
take appropriate technical and organizational measures against accidental loss and damage, as well as illegal processing of personal data.
8.4. The Webmaster undertakes to prevent any action that could result in PROPS Partners violating applicable Personal Data Legislation (Data Regulation).
The activity of collecting and processing Personal Data is regulated:

Subject to applicable law, the Webmaster will notify visitors to its website of the use of cookies, including those placed by PROPS Partners (so-called third party cookies). The Webmaster must explain to users what cookies it has set and for what purposes it collects this information. In addition, you must obtain the informed, unambiguous and revocable consent of all users to collect information through these cookies before setting any cookies on their browsers. The consent must also apply to cookies that are set by PROPS Partners after a specific action (click).
9.1. Each Party undertakes to use the Confidential Information only to fulfill its rights and obligations under these Terms and Conditions. The Parties undertake not to disclose the Confidential Information.
9.2. Confidential Information shall not be considered Confidential Information,
which is or subsequently became publicly available without violation of this Agreement by the Receiving Party;
that has been legally obtained from Third Party without limitation and without violation of this Agreement, as well as without obligations of the Receiving Party not to disclose it;
which cannot be referred to the Confidential Information in accordance with the current legislation;
that is published on the PROPS Partners System when receiving or providing services under these Terms and Conditions.
9.3. Upon account deletion, PROPS Partners will delete all personal information about the Webmaster except for login and statistics.
9.4. Paragraph 9 is valid for 5 years from the date of termination of this Agreement.
10.1. The information obtained in the process of participation in the PROPS Partners network is allowed to be used exclusively within the framework of the Partner Network. Transfer to third parties and use for other purposes is prohibited.
10.2. The PROPS Partner Network and its components (products and applications) are protected by applicable copyright and related legislation.
10.3. PROPS Partners grants to the Webmasters a temporary, non-exclusive right to use the services and applications provided and the data contained therein solely as part of the PROPS Partners Affiliate Network. In the event of termination, this right will cease to apply.
10.4. Other ways of using the information are prohibited. The Webmaster is forbidden to transfer the rights granted to him to use the services, applications and data to third parties in whole or in part, to access, modify or otherwise process them, transfer in other forms or create their own databases or information services from them.
10.5. PROPS Partners reserves the right to use other legal means, other than termination, in violation of these usage rights. If administrative or other legal liability is instituted against PROPS Partners due to a third party's breach of these Terms and Conditions by a Webmaster, all attorneyship and other costs, resulting from the breach will be fully withheld from the culpable Webmaster.
11.1. PROPS Partners shall not be liable for any damages or interference caused by third party web content, software or hardware errors in the Partner Network, or damage caused by the lack of availability or limited functionality of the Internet.
11.2. PROPS Partners are otherwise liable for
willful misconduct or gross negligence of its legal representatives or employees;
breach of material obligations of the contract, which make it possible to implement these Terms and Conditions and on which the other party constantly relies in confidence.
11.3. Material liability under Clause 11.2 shall be limited to compensation for actual damages to be determined by the parties or by court decision.
11.4. The foregoing limitations of liability do not apply to mandatory legal liability, and do not limit or exclude PROPS Partners' liability in the event of injury to life or health.
12.1. PROPS Partners reserves the right to change the terms of these Terms and Conditions without justification and at any time. It is the Webmaster's sole responsibility to review these Terms and Conditions on a regular basis.
12.2. Use of the PROPS Partners network by the Webmaster following any changes to these Terms and Conditions constitutes acceptance by the Webmaster of the changes and the acceptance of the Webmaster's obligations under these Terms and Conditions. Failure to agree to the changes to these Terms and Conditions will result in termination of this Agreement and PROPS Partner Network.
13.1. If certain provisions of these Terms and Conditions and the Regulations are terminated in whole or in part, the remaining provisions shall remain in force. The invalidated provision shall be deemed to be replaced by another one that is closest to the intent and purpose. The same shall apply to any provisions of these Terms and Conditions that may have been overlooked.
13.2. The rights and obligations under these Terms and Conditions may only be transferred to a third party with the permission of PROPS Partners.
13.3. The use of PROPS Partners' Partner Network services requires the use of certain hardware and software packages, telecommunications networks and third party services. PROPS Partners will not be liable for any consequential costs, possible damage or interference.
